L-1 Visa and Its Types

Business can be a global thing, in the sense that transactions and other business-related tasks can involve multiple countries. For this reason, the United States have different visas, laws, and regulations for employees from different countries. This can be particularly bothersome for the countries the United States are commonly associated with when it comes to business, such as the case for Russian business immigration. One of the visas available for employees is called the L-1 visa.

The L-1 visa is a non-immigrant visa for employees of an out-of-country company that has offices in the United States. To be eligible for the L-1 visa, an employee must have worked for the company for at least one year, prior to the three years before U.S. admission. The U.S. and non-U.S. company should also be related in at least one of the following:

  • Parent company and subsidiary
  • Headquarter of company and branch
  • Companies are sister companies with a mutual parent
  • Companies have similar affiliations

Getting L-1 visas can be relatively easier for well-known companies. But for startups and small businesses, their owners might need to present viable documents to prove their eligibility.
It is also important to point out that there are two kinds of L-1 visas. They are known as the L-1A and the L-1B.

L-1A Visas
This kind of L-1 visa is for executives and managers. To be eligible for an L-1A visa, an employee must be in a qualifying position, such as an executive or managerial one. The employee should also be coming to the United States with executive or managerial capacity.
Executive capacity refers to the employee’s ability to manage or direct the organization or its major components, while managerial capacity refers to the employee’s ability to supervise or control the organization or its branches and departments.

L-1B Visas
This kind of L-1 visa is for those who have specialized knowledge capacity. Specialized knowledge capacity refers to the employee’s expertise that are not commonplace in the company, warranting the effort to travel into the United States. Specialized knowledge may come in many forms, such as expertise in a particular product or service.
